Same thing that’s kept all the other emulators from being taken down: not being illegal.

Nintendo decided it was. Nothing else, to my knowledge.

True but I dare say it was quickly followed with an “or else”. We do know about Nintendo’s mafia, after all so only offering the nice hand feels very off.
